UFC lightweight Drew Dober fell victim to one of the worst referee calls in the history of the UFC on Saturday night, as referee Eduardo Herdy called a stop to his bout with Leandro Silva as he was about to pop his head out of an ineffectively applied guillotine choke. Herdy's move gave Silva the win, despite the fact that Dober wasn't close to out and would have had top control in the half guard.

UFC President Dana White said afterward that Dober would be paid his win bonus, and agreed with many who feel the fight result should be overturned. Unfortunately for Dober, one official from the Brazilian commission (CABMMA), says that's just not possible.

"We can't change the result," CABMMA COO Cristiano Sampaio said in an interview with Combate (translated via Guilherme Cruz at MMAFighting.com). "There are three cases where the result can be changed: when the scorecards indicate a different result; when there's collusion between judges, when they decide who's going to win, something that happens outside (of Brazil) with betting; and when the failure in the interpretation of the referee that generates a different result than was to have been.

"That was an error of fact," he continued. "The error of the rule is when there is a failure in the interpretation of the law. We have to review the fight, the referee's position, which body signals the athlete had, indicating that he passed out or not. Some factors have to be analyzed. But it was not an error of the rule, and had nothing to do with the interpretation of the rule. Today, by the standard of the athletic commission protocol worldwide, there is no way we can change this result. But we have to sit down, discuss and review. Rule is one thing, his performance is another. They are distinct. That's not the case here, so Leandro ‘Buscape's' win will likely be maintained."

Dober is still going to file his appeal, saying he was under the impression the commission wouldn't comment until reviewing his case on appeal, but it's looking likely that it will be a futile exercise.

Penick's Analysis: There will be no improvement in MMA judging and officiating so long as the regulatory bodies governing the sport refuse to hold them accountable for their mistakes. When a blatantly wrong call like this happens, there should be some recourse for the fighter on the losing end, and the official who screwed up should be disciplined. Instead, commissions throw their hands in the air and say "there's nothing we can do" and don't do anything to address the erring official. It's a complete shame, because Herdy should never referee another major event again, but you can be assured that he'll be booked by this commission the next time the UFC comes to the country.
